TL;DR

The Minimum Energy Efficiency Standards (MEES) require that from 1 April 2023, it will be an offence to continue to let or rent out a commercial property if it does not have an EPC rating of at least E. In 2027 a C rating will be required and then a B rating in 2030.

2018 saw the Minimum Energy Efficiency Standards (MEES) come into force, bringing about the requirement that no new commercial tenancy be created without the property having an Energy Performance Certificate (EPC) rating of E.

From the 1 April 2023, this requirement will tighten so that all tenanted commercial properties will have to achieve at least an E rating on their EPC, regardless of whether the tenancy is new. Failure to comply will be an offence which will carry a hefty financial
penalty based on the rateable value of the property and details of the breach may also be made publicly available.

Following this, the Government’s MEES target is that by 2030, commercial properties, unless exempt, must have a an EPC B rating. The proposal is to have a two-phased approach so that commercial properties must have an EPC rating of C or higher by 1 April 2027, and B or better by 2030:

Phase One: EPC C (2025-2027)

  • By 1 April 2025: A valid EPC must be presented by landlords of non-domestic rented buildings within the scope of MEES 

  • By 1 April 2027: Improvements to the buildings to achieve EPC C or greater must be completed

Phase Two: EPC B (2028 – 2030)

  • By 1 April 2028: A valid EPC must be presented by landlords of non-domestic rented buildings within the scope of MEES 

  • By 1 April 2030: Improvements to the buildings to achieve EPC B or greater must be completed
